Maybe thats the bone the College Board threw to ETS to compensate for having taken the actual test-writing away. Or maybe theyre just trying to distance themselves from Pearson.   Update: Hardly had I published this post  when I discovered recent information indicating  that ETS is still playing  a consulting role, along with other organizations/individuals, in the creation of the new SAT. As a punishment for her crime, Hester is forced to wear the letter A on all of her clothing and is shunned by everyone in her town. Hester begins to work towards earning the respect of the village people again by doing charitable deeds and living out her life quietly, without causing any problems. The longer this goes on, the more respect the village people have for her and eventually she is able to travel around the village without being scorned and shunned by everyone. Easy A follows the same premise as The Scarlet Letter; however, the movie is modern, so the actions and consequences will be quite different than the book. Olive Penderghast was a very quiet and lonely high schooler until one day everything turned upside down. One day, Olive was talking to her best friend in the bathroom and had lied to her about losing her virginity to a nonexistent college boy because she didnt want to fit in with the rest of the school. This backfired because a religious girl at her school heard her fake story and spread it as a rumor around the whole school. People at her school begin to slut-shame her and try to avoid her at all cost. Instead of letting the comments get to her, she decides to take matters into her own hands and changes the way she dresses and acts as well as sewing a red A onto all of her clothes. She then embraces that people believe she is a slut and pretends to sleep with guys and in return she gets gift cards, money, and other gifts. Eventua lly, Olive loses all of her friends and wants to tell the truth, but none of the boys that paid her for her virginity will come forward and tell the truth. She decides that she wants to come forward with the truth and does so by announcing everything she has done on her webcast. Now, the whole school knows all the stories they have been told are fiction and eventually she earns her friendships back and gets a date with a guy who really likes her. Obviously, there are some similarities between the book and the movie, but there are major differences between Hester Prynne and Olive Penderghast. One of the major differences between Olive and Hester is why they have the red A sewn onto their clothes. For Hester, the A represents the adultery that she committed and she has to wear it as a punishment for the crime she has committed, so everyone in the village can know what she has done. On the other hand, Olive chose to sew the red A onto all of her clothes, not as a punishment but because she wanted to attention of everyone at her school. Olive changed everything about her because she enjoyed the attention she had been getting since everyone thought she was sleeping around. She had never had attention like this before, so she wanted to do everything she could to continue it. Olive adds more fuel to the rumor by make a false statement that she was being paid to sleep with many different men all to gain more attention. This is differ ent than Hester because she does not want any more attention than the attention she already has. She instead tries to change the villages opinion of her and wants them to see her as a strong, independent mother instead of an adulterer. Another other major difference between Hester and Olive is that in the beginning of the movie, Olive is someone that does not get attention from anyone at her school and has a deep desire to become popular and like by her peers. In order to achieve this popularity, Olive decides to let the rumors grow because she wants to fit in, but eventually the rumors become too big and she is isolated by all of her classmates. Hesters situation is completely different. She was born a Puritan and as a Puritan she was born into a society that had strict rules and if one deviated from them then they would be punished. Hester becomes an outcast of the Puritan community and she slowly finds her way back through hard work. The way the two characters decide to resolve their problems is also vastly different. Olive realizes the negative effects that the rumors have had on her life and friendships and decides to finally tell the truth, which is that everything she has been saying about herself was a complete lie. Whereas, Hester admits to the crime she has committed and does hard work around her village to pay off those crimes. Although both the book and the movie have a happy ending with Olive getting her friendships back and Hester being able to be with the man of her dreams, the way they had to get to this point is different. These differences are a result of the different societies and time periods they live in. Hester could not just admit to her crime and then immediately be accepted back into society, but with hard work and determination she was able to. Olive; on the other hand, was simply able to admit to her wrongdoings and everything in her life went back to normal and no hard work was needed to put her in that position.

It is how we value ourselves and how we think about, affects our behavior. There are two aspects of self esteem that are self respect and self confidence(Piko BF, 2016). Self confidence is about choosing our actions and goals. It is about our belief in succeeding and accomplishing our goals. Whereas self respect is about values and principles that ensure that we make moral choices. Self respect is our personal worth that is based on how we rate ourselves. Self esteem is crucial during the adolescence years as they notice changes in their body and thinking. They notice changes in the surroundings around them. Coping with issues is about developing an individuals self esteem. During childhood these children depend on their parents and families for decisions and support but now in adolescence stage the y do not want to ask their parents for advice. They tend to listen to friends and peers who they can relate to rather than listening to family members and teachers. When men turned eighteen, they had to register with the draft. The draft had many changes; one was that if an individual was enrolled in college they could receive a deferment and not have to be drafted in the military until after college. However, once they graduated their name would be put to the top of the list to be drafted and deployed immediately. With this policy in effect many colleges and universities became involved in anti-war movements. Most of the faculty and students did not believe in the war and its cause. Between the years of 1961 and 1973 the war claimed 57,000 American lives and left more than 300,000 wounded. (Davidson, 2005) Come graduation time many students feared the reality of the draft. Many students protested and voiced their opposition to the war. With fear there was the distrust of the government figures in charge and they publicly questioned the governmentâ„ ¢s judgment on handling the war. When the United States announced they would begin to send troops to Cambodia there was such a large protest that the National Guard had to be called in to control the situation. There was fear the protesting would turn into rioting and businesses would get damaged in the process. Come May 4th, 1970, Kent State Universityâ„ ¢s anti-war rally grew to almost 3,000 people in support of the anti-war movement. The National Guard had to use tear gas, when that did not work due to windy weather they attempted to enforce the Ohio Riot Act with raised bayonets, forcing demonstrators to retreat. (Kent State University, n.d.) As a result of the National Guard attack toward the protestors, nine students were injured, one of which was left paralyzed, and four died. This incident put Kent State University in the spotlight and added fuel to the 1970â„ ¢s continuing anti-war movement. Many Americans feared them and their families could be victims on another incident like the Kent State University event. Parents began to question the draft, the Vietnam War, and American politics. Many of the peace talks that were organized were not carried out so peacefully. American soldierâ„ ¢s lives were not the only things that Americans paid with for the war. The United States had put in over $120 million into supporting the war and the soldiers. With that inflation rose and President Johnson had to raise taxes. Unfortunately, the Republicans would not approve the tax raise with their being a cut to the social welfare programs. It was clear the United States did not have the resources or wealth to remain dominant over the world. President Nixonâ„ ¢s Doctrine allowed America escape itâ„ ¢s military obligations by placing responsibility on other allied countries. With this happening, Americaâ„ ¢s foreign military sales went from $1.8 billion to $15.2 billion in the next six years. (Davidson, 2005) As America was withdrawing from the Vietnam War it began looking for ways to contain the Soviets without the use of violence. They first needed to remove any threat of the Sovietâ„ ¢s nuclear weapons. The United States allowed some nuclear concessions and the Soviets vowed to lower their supply, with both nations agreeing not to make any new missiles by signing Strategic Arms Limitation Treaty. Ballet or football Essay Ballet and football are both difficult sports to master; however, someone once said, â€Å"If ballet were any easier, they’d call it football. † What makes for a good sport? Every sport has rules and regulations that one must follow in order to play. The sport requires specific skills such as strength, coordination, and speed. A good sport has a certain level of safety to keep the participants safe and requires a lot of teamwork so that every is playing together. I personally think ballet is the more technical of the two. Ballet is much more complex than football. Every sport requires you to follow certain guidelines. In football, the player can’t grab the opponent in certain ways or a yellow flag will be thrown on the ground to indicate holding or some penalty that no one has even heard of before. Football has rules that the team must obey. On the other hand, ballet is less restricted than football. They are no rules in ballet. Ballet is a form of art; there are no limitations on art. Ballet is not about winning or following any rules; it is about expression through movement. Although there is more freedom in ballet, there is a lot of technique required. You must hold your arms a certain way so that they do not droop, and you must always remember the turn out of your thigh when you tendu. Ballet may not have rules, but there are still plenty of little details to remember. Strength is a major component of almost any sport. In football, the quarterback relies on two hundred and fifty pound linemen to block so that he can get the ball in the end zone. The defensive linemen have to use their upper body strength to hold the opposing team and keep them from getting to the ball. The Oneida Community Throughout the early years of the United States, Utopian communities seemed to be quite prevalent. Though most did not last long, their ideas of perfection have long outlasted the settlements themselves. Of the many trial settlements one of the most noted was that of the Oneida community that was founded in the late 1840’s by John Humphrey Noyes. Noyes’ society of self-proclaimed perfectionists was started after he lost his preaching license in an attempt to spread his new ideas of communal living. 1 The Oneida society, like many societies of this era, was based on seemingly radical religious as well as societal ideas. In the early years, the community thrived partially because there was no conflict between its scientific and religious ideas. As the society grew and progressed toward it’s downfall, a significant separation of science and religion was becoming evident. Many believe that it was this growing conflict between science and religion that was ultimately the deteriorating element of communal living among the members of the Oneida experiment. John Humphrey Noyes, son of John Noyes and Polly Hayes Noyes, was born on September 3, 1811 in Brattleboro, Vermont. As the son of a well-educated businessman and an inquisitive mother, the young John was encouraged to love learning. After attending many schools in Vermont and Massachusetts John entered Dartmouth in hopes of completing his education. The Exxon Valdez 1989 Oil Spill

This summary will briefly discuss three topics: a) the oil spill, b) the environmental damage and clean up, and c) the insurance coverage settlements. This paper will then focus on the insurance coverage settlements. Afterwards, it will provide an analysis on the effectiveness of the dispute resolution process. The Exxon Valdez Oil Spill of 1989 was one of the largest manmade environmental disasters (Rodgers et al, 2005, p. 136). It occurred in U. S. waters at Prince William Sound, Alaska in March 1989 (Rodgers et al, 2005, p. 136).The oil tanker, Exxon Valdez, struck a reef and discharged an estimated 10. 8 million gallons of oil according to Exxon estimates but other sources indicate that it is around 30 million gallons (Rodgers et al, 2005, p. 136). The oil belonged to Exxon Corporation while the tanker belonged to Exxon Shipping, its subsidiary (Holman, Fenwick & Willan, 2004, p. 1). The environmental damage caused by the oil spill and the subsequent clean up of the spill and its contaminants became the subject of numerous litigations (Rodgers et al, 2005).Environmental damage claims and settlements ran into several billion U. S. dollars (Rodgers et al, 2005, p. 149-88). Oil spill clean up expenses likewise ran into several billion U. S. dollars (Holman, Fenwick & Willan, 2004, p. 2). In this regard, due to the huge volume of lawsuits, the complexity of the case or cases, the wide coverage of the disaster, and the disaster’s far-reaching implications among other considerations, Exxon Corporation undertook a wide variety of legal strategies. One of those strategies involved alternative dispute resolution through settlements for insurance coverage disputes.The Exxon insurance coverage disputes are complex (Covington & Burling LLP, 2007). One point of consideration is that Exxon’s primary insurers are reinsured with Lloyd’s London (Holman, Fenwick & Willan, 2004, p. 2). This complicates the disputes since Exxon is an American company while its underwriters are international business entities. Hence, the dispute involved significant activities in many locations: Texas, New York, London, Oslo, Alaska and other places (Covington & Burling LLP, 2007).As such, issues on jurisdiction and applicability of laws whether English law or New York law should be applied made litigations costly and long. Covington & Burling LLP represented Exxon from 1991 to 1997 in â€Å"its hotly contested, multi-forum claims for coverage of losses arising out of the grounding of the Valdez† (Covington & Burling LLP, 2007). In early 1997, these disputes ended after Exxon and the Lloyd’s consortium of international underwriters and various Scandinavian companies settled for $780 million (Treaster, 1996; Covington & Burling LLP, 2007).Covington & Burling LLP (2007) best describes the legal complexity of these disputes, to quote: The Exxon claims arose out of the company's Global Corporate Excess package of policies for 1988-89, which was characterized by high limits and high retentions. Exxon claimed coverage under various sections of the package, including the first-party property section's cover for removal of debris, the marine liability section's cover for cargo-owner pollution losses, and the general liability section's cover for pollution clean-up costs.Meanwhile, the Covington & Burling LLP strategy involved: a) â€Å"a non-binding ADR procedure moderated by a London-based barrister before any litigation commenced;† b) â€Å"a Texas lawsuit filed by Exxon that the underwriters unsuccessfully sought three times to remove and that resulted in a jury verdict for Exxon on one of its three claims;† c) â€Å"an arbitration proceeding in New York;† d) â€Å"a federal declaratory judgment action in New York that the underwriters struggled to keep alive despite a dismissal and multiple trips to the Second Circuit and the Supreme Court on jurisdictional issues;† and finally,e) â€Å"two settlements — one for $300 million before the Texas verdict and one for $480 million while the Texas verdict was on appeal and just before the arbitration hearing was to commence† (2007). Many forms of alternative dispute resolutions or ADR can be made. Balmer (n. d. ) notes that several types of ADR can in fact be customized as can be seen from the Exxon insurance settlements. Some of these customized ADRs can range â€Å"from non-assisted discussions through mediation, neutral fact finders, case exposure such as mini-trials, arbitration both binding and non-binding, and limited issue litigation† (Balmer). Exxon already spent some U. S. $ 2. 5 Billion in damage claims as a result of the oil spill (Rodgers et al, 2005).Without ADR, it would have been unable to recover some $780 million from its insurance coverage (Treaster, 1996) while Exxon’s insurance disputes could have been unnecessarily protracted. For this incident, Exxon employed litigation but was always open to the many forms of alternative dispute resolution. For instance, Exxon used mediation through a non-binding ADR procedure moderated by a London-based barrister before any litigation commenced (Covington & Burling LLP, 2007). Technically, mediation involves a neutral third party who helps in hammering out a resolution (Balmer). In another instance, Exxon employed arbitration proceedings. Balmer describes arbitration as â€Å"getting a neutral party or panel to reach a decision on facts, law or both.† Most importantly, Exxon often used settlements.
